4. Payments and Billing
Payment terms are outlined in your specific Service Agreement. Unless otherwise stated:

5. Warranties and Service Limitations
Black Diamond Landscaping stands behind its craftsmanship and materials.

Limited Warranty: We offer warranties on certain installations (e.g., paver work, turf) as specified in your individual service agreement.

Exclusions: Warranty does not cover damage caused by weather, misuse, lack of maintenance, or work performed by third parties.

No other warranties—express or implied—apply beyond what is explicitly stated in writing.

6. Inspection and Notice of Deficiencies
Clients should inspect completed work and notify Black Diamond Landscaping in writing of any visible damage, deficiency, or corrective work required within seven (7) calendar days after the applicable service or completion of the work. This requirement does not apply to latent defects that could not reasonably have been discovered during that period.
7. Cancellations and Refunds
Cancellations must be submitted in writing before work begins. Deposits may be refundable or non-refundable depending on material procurement or scheduling commitments. Once work has started, refunds are issued only at our discretion and based on the percentage of work completed.
8. Media and Photography Rights
Unless a Client provides written notice that they do not authorize such use, Black Diamond Landscaping may photograph or video a property before, during, and after the performance of services for documentation, quality control, training, warranty administration, portfolio, marketing, advertising, social media, and other promotional purposes. We will not intentionally disclose confidential information or imply that a Client endorses Black Diamond Landscaping without permission.
9. Intellectual Property
All content on this Site—including text, images, logos, videos, and designs—is the property of Black Diamond Landscaping or its licensors. You may not copy, reproduce, modify, or distribute any part of the Site without prior written consent.
10. Force Majeure
Black Diamond Landscaping shall not be responsible for delays or additional costs caused by weather, material shortages, labor disruptions, utility delays, governmental actions, acts of God, or other events beyond its reasonable control.

15. Dispute Resolution and Governing Law
In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith negotiation, and if necessary, mediation, before pursuing litigation. Any disputes shall be resolved in the courts located in Dallas County, Texas.
